SNIPER – A new Credit Recovery system starts to operate

In October of 2022, SNIPER, Nacional System of Financial Investigation and Asset Recovery, started its operations and it is already ready to be used on the most variable judicial procedures, especially focused on asset recovery.

The SNIPER has been developed by the National Council of Justice (“CNJ”) and aims to optimize, expedite and centralize the search for debtors’ assets, undertaking not only to locate assets more quickly, but also to identify, by cross-referencing data from various state agencies, the ownership, corporate and financial links between individuals and legal entities. In other words, SNIPER was born with the objective of centralizing the search for assets and information about third parties who may have received assets deliberately to defraud creditors or execution.

In general terms, SNIPER system proposes to access the databases of Brazil´s Superior Electoral Court, Brazil´s National Aviation Agency, the Federal Revenue Service, the Office of the Comptroller General, the Maritime Court related to the Brazilian Navy, the Infojud and Sisbajud systems (research systems frequently used by Brazilian Courts), both in the implementation phase, the National Register of Legal Entities. This initial list of databases will certainly grow over the coming months and years.

As it is known, it is common for lawsuits to get stuck in the execution phase, exactly because some debtors use artificial means to transfer or hide their assets.

There are a few systems which help in the research for assets and even identify fraudulent operations and trades, but most of the time they are not efficient, and the creditor faces difficulties in enforcing their rights.

The SNIPER system, by its turn, promises to revolutionize the area of credit, showing series of important information, which before demanded research and diligence in several systems and agencies, in just a few seconds and in a very didactic way (graphics, for example), facilitating the identification of solutions for credit satisfaction.

As CNJ informs, the system uses innovation and technology to give more efficiency, transparency, and celerity to judicial process, guaranteeing people true access to Justice.

However, it is important to mention that the information and the data reveled by the SNIPER system need diligent and specialized action by lawyers, both need to convince judges in the use of the system, because the judge is responsible for operating the SNIPER system through the Judiciary’s Digital Platform, and because of the lawyer´s role in the interpretation and efficient use of the data obtained for the clients benefit.
