Loss of Validity of Provisional Measure No. 873

July 4, 2019

By Paola Gabriela de Carvalho Tosta

On July 3, 2019, a notice signed by the President of the Senate, Davi Alcolumbre, was published in the Official Gazette of the Union regarding the expiration of Provisional Measure No. 873 (MP No. 873). The scope of MP No. 873 was to prohibit the deduction of union dues directly from payroll, determining that said dues could only be paid by bank slip and only by employees who had expressly consented to the payment in favor of the union.

With the loss of effectiveness, Law 13,467/2017 comes back into force in its original terms, maintaining the need for prior and express approval from each employee for making deductions from the payroll.
