Financial Restructuring

The corporate restructuring and recovery market in Brazil requires the work of professionals with multidisciplinary knowledge given its complexity and scope.

We offer legal advice that, combined with strategic and financial planning, aims to achieve the company's economic recovery and overcome financial crises.

Judicial and Extrajudicial Recovery are procedural remedies available to companies that are experiencing financial difficulties and need to renegotiate their debts to allow them to continue their activities.

The recovery procedures (RJ and REJ) not only allow renegotiation with creditors, but also the suspension of restrictive acts carried out by creditors, allowing the company to safeguard the assets necessary for the continuity of its activity.

Our Restructuring Team offers the following services in judicial or private debt renegotiation processes:

Studies and analysis of the debt profile, verifying the best alternative for financial restructuring and, if necessary, filing for Judicial or Extrajudicial Recovery;
Consulting in the sale and acquisition of assets of companies in financial difficulty, undergoing judicial recovery or originating from bankruptcy, covering risk assessment, drafting of contracts, negotiation and modeling of operations and recovery plans;
Advice for Debtors, Creditors and Investors in corporate credit operations in financial difficulties;
Defending Clients' interests in the recovery of credits in judicial recovery processes or extrajudicial or in bankruptcy, including representation on committees, coordination with other creditors, review of recovery plans, as well as in legal actions and appeals in courts;
Opinions on the application and impact of the Bankruptcy Law, covering topics such as succession, sale of assets, credits subject to and excluded from judicial recovery, interaction with foreign rules and legislation.
