The Data Protection Officer (DPO) has entered the Brazilian Classification of Occupations, CBO.
Among the professions included by the Ministry of Labor and Social Security are skateboarders, DPOs, e-commerce analysts and more than 2 thousand recognized occupations, which have the integration of Income Tax declarations in the Annual Social Information Report (RAIS), and in National Employment Systems.
However, such recognition will not necessarily generate new labor rights, such as vacations, 13th salary, working hours or registration of the employment contract. In fact, the recognition is that the DPO is an occupation with its own characteristics.
Therefore, the Ministry of Labor and Social Security itself seeks to analyze the CBO as a classification that aims to identify occupations in the labor market, for exclusive classification, being of an administrative nature, and not necessarily linked to labor relations.
Finally, it is important to mention the way in which this recognition is made after contact with those working in the area, linked to various studies on the function of the category, to verify whether they meet all the necessary requirements, such as specific knowledge and skills for the performance, as well as involvement of the function with interest and social responsibility.
