The deadline for large and medium-sized Brazilian companies to voluntarily register with the Electronic Judicial Domicile, a tool of the Justice 4.0 Program that centralizes procedural communications from all Brazilian courts on a single digital platform, ends on May 30. After this date, registration will be mandatory, using data from the Federal Revenue Service, with penalties and risk of missing procedural deadlines for those who do not register in time.
Deadlines
Electronic citation is established in article 246 of the Code of Civil Procedure. In 2022, CNJ Resolution No. 455 regulated the law, determining that procedural communications be carried out exclusively through the Electronic Judicial Domicile. Registration is mandatory for the Union, States, Federal District, Municipalities, indirect administration entities, public and private companies.
The tool imposes specific deadlines for reading and acknowledging the information issued: three business days after the courts send citations and 10 calendar days for subpoenas. Ignorance of these rules can lead to procedural delays and financial losses.
Registration Phases
The release of the Domicile occurs in phases, according to the target audience. The first phase, carried out in 2023, was aimed at banks and financial institutions, resulting in the registration of 9 thousand companies. The current phase, focused on private companies, has an estimated audience of 20 million companies.
Small and micro-enterprises with an electronic address in the integrated system of the National Network for the Simplification of the Registration and Legalization of Companies and Businesses, as well as individuals, are not required to register, although the CNJ recommends registration from October onwards.
Business owners and legal department managers must pay attention to these deadlines and guidelines to avoid penalties and ensure efficient compliance with their procedural obligations.
