Banco BMG was sentenced by the Court of Justice of the State of São Paulo to pay a millionaire amount of R$6.6 million for having caused inconvenience through telemarketing to people who had refused to receive calls through this communication channel.
The Court understood that there was negligence on the part of the Bank, violating the provisions of the Consumer Protection Code and State Law No. 13,226/08, which deals with the rights of users who feel inconvenienced by registering their telephone numbers so that they are no longer accessed by telemarketing services from various companies.
The records contain 46 calls to consumers of the financial institution, who had already requested that such calls be blocked.
It is important to note that, recently, actions related to telemarketing by companies and the harassment of people have come under the scrutiny of the justice system. Recently, Anatel made it mandatory to add the prefixed 0303 number to dialed numbers, in an attempt to curb abuses by companies with excessive calls.
