The term for the new wording of NR-1 (Occupational Risk Management) to come into effect has been extended

As previously reported by our office, it was expected that, as of May 2025, all Brazilian companies would be required to include psychosocial risk assessment in their Occupational Health and Safety (OHS) management processes. The requirement results from the update of Regulatory Standard No. 1 (NR-1), promoted by the Ministry of Labor and Employment (MTE) in August 2024.  

This Friday (16), Ordinance MTE nº 765 was published, extending the deadline for the validity of the new wording attributed to chapter “1.5 – Occupational Risk Management” of NR-1.  

The new deadline set by the MTE applies exclusively to psychosocial factors, which involve aspects such as the way work is organized, interpersonal relationships, management culture, pressures for performance and the emotional conditions to which workers are exposed. These are risks that, although not visible, cause significant impacts on the mental health of professionals, with direct repercussions on absenteeism, turnover and organizational performance.  

The extension aims to allow employers to adapt to the new reality. To do so, they will have a period of 12 months, starting on May 26 of this year. It is important to note that the extension refers only to the application of inspections by the MTE, without imposing fines or penalties, and is of an educational and guidance nature. Thus, the measures aimed at protecting the psychological health of employees have been in effect since May 25 of this year and must be duly observed by companies.
