The National Consumer Defense Council (CNDC), after noticing the increase in complaints related to violations of consumer personal data protection standards, announced the recent creation of a specialized center on the subject, with the aim of promoting the protection of consumers' personal data.
The CNDC was established by Decree No. 10,417/20, in July 2020, with the objective of “advising the Minister of State for Justice and Public Security in the formulation and implementation of the National Consumer Protection Policy, and also formulating and proposing recommendations to the bodies that are part of the National Consumer Protection System for the adaptation of public consumer protection policies.”
In practical terms, the CNDC promotes discussions on certain topics involving consumer relations, enabling dialogue between regulatory bodies and agencies that represent the interests of consumers and suppliers.
In view of the current scenario, in which personal data has gained special protection through the General Data Protection Law (LGPD), in force since September 2020, the CNDC felt the need to have a department specialized in the subject, aiming mainly to maintain a relationship with the National Data Protection Authority (ANPD), recently created. The first meeting with the ANPD is expected to take place in February.
With the creation of this personal data protection center, the tendency is for the CNDC to be an important means of promoting and monitoring compliance with the LGPD by suppliers.
