We inform you that as of today, February 15, the deadline for submitting the declaration of the Census of Brazilian Capital Abroad (“CBE”) is open, in which residents in Brazil must declare to the Central Bank the existence of values of any nature held outside the country, including assets, rights, financial instruments, cash in foreign currencies, deposits, real estate, shares in companies, shares, bonds, commercial credits, etc.
Individuals or legal entities resident, domiciled or headquartered in Brazil, who hold abroad at least US$1,000,000.00 (one million dollars), or equivalent in other currencies, on December 31, 2020, are required to participate in the CBE. In the event that the individual or legal entity has amounts greater than US$100,000,000.00 (one hundred million dollars), the quarterly CBE must also be completed, referring to the base dates of March 31, June 30 and September 30.
The CBE delivery deadlines are as follows:
(a) Annual CBE: Until 6:00 p.m. on April 5, 2021
(b) Quarterly CBEs:
• Quarterly declaration referring to the base date of March 31st: From April 30th until 6 pm on June 5th of the same year;
• Quarterly declaration for the base date of June 30: From July 31 until 6 pm on September 5 of the same year; and
• Quarterly declaration for the base date of September 30: From October 31 until 6 pm on December 5 of the same year.
Fines for failure to declare range from R$2,500.00 to R$250,000.00, and may be increased by R$50% in some cases.
