After inspections began in pharmacies in Cuiabá, between May 4th and 5th, 2021, PROCON-MT applied a fine in the amount of R$572,680.71 to the RD group, after inspecting 6 establishments in the capital.
This operation was initiated at the request of the MPE-MT, as a result of complaints from consumers that were directly forwarded to the PROCON of the region. The allegations registered alleged coercion of the rights of the holders in the promotions, with a lack of clarification on what was done with the data collected from citizens, something that is necessary and ordered through the General Data Protection Law (LGPD).
The fine was based on the economic condition of the units in the region. Furthermore, during the approach, numerous maneuvers to circumvent the consumer's understanding were found, through: Re-registration; Consent Form and the interpretation of the LGPD itself.
The LGPD aims to guarantee the transparency of personal data in any medium. Among the new rules linked to it, there is greater control by the data subject over their information, requiring explicit consent regarding its collection and use by companies, as well as requiring such suppliers to edit or delete personal data. In the case of pharmaceutical networks, as seen, erroneous consent is prohibited by the new rule.
