National Consumer Secretariat and ANPD discuss agreement to protect consumer data

Last Monday (15), the National Consumer Secretariat (Senacon/MJSP) and the National Data Protection Authority (ANPD) met to continue negotiations on an agreement aimed at protecting consumer data, called the Technical Cooperation Agreement (ACT).

The agreement provides for the sharing of information by Senacon with the ANPD regarding consumer complaints related to violations of the protection of their personal data, enabling greater effectiveness in monitoring possible violations of the General Data Protection Law (LGPD). The central idea of the agreement is the standardization of understandings and interpretations of the LGPD among the regulatory bodies.

The Consumer Protection and Defense Department (DPDC) is already investigating dozens of cases involving possible data leaks from thousands of consumers and has shown interest in contributing to the ANPD on several fronts.

Recently, the National Consumer Defense Council (CNDC) created a specialized center for data protection (see https://www.mazzuccoemello.com/conselho-de-defesa-do-consumidor-cria-nucleo-de-protecao-de-dados-pessoais/).

According to the president of ANPD, Waldemar Gonçalves, the partnership with Senacon is especially important due to the increase in data leak incidents in Brazil.

The Technical Cooperation Agreement is expected to be consolidated in March of this year.
