Our office specializes in providing comprehensive legal advice to companies operating in foreign trade, offering advisory and litigation services on issues customs.   1. Customs Consulting:
    • Customs Compliance: Implementation of compliance programs to ensure that all foreign trade operations comply with customs, tax, regulatory and international legislation.
    • Legal Support on Topics such as:
      1. Tax Classification of Goods (NCM): adaptation of operations to the requirements of the Federal Revenue Service and the correct application of taxes and regulatory treatments.
      2. Special Customs Regimes: Consultancy on the use of special customs regimes, such as Drawback and RECOF, focusing on reducing taxes and optimizing import and export processes.
      3. Customs Planning for Import and Export: Development of customs optimization strategies, aiming at reducing operational costs, efficiency in logistics flows and minimizing the risk of fines.
      4. Advice on Antidumping Investigations: Legal consultancy for companies involved in anti-dumping investigations, conducted by the Secretariat of Foreign Trade (SECEX), aiming to defend the interests of our clients against the imposition of anti-dumping tariffs and other trade defense measures.
  2. Customs Litigation:
    • Defense in Customs Proceedings: Representation of our clients in administrative and judicial proceedings related to fines, defending them against penalties and seeking the reduction of fines or even the cancellation of infraction notices.
    • Disputes over Tax Classification and Customs Valuation: Advice and defense in disputes involving the tax classification of goods, disputes over customs values and the customs valuation of imported goods, in accordance with the requirements of World Customs Organization (WCO) and national legislation.
    • Recovery of Credits Linked to Foreign Trade: Consulting and representation in the identification and recovery of tax and customs credits, related to taxes paid unduly, such as Import Tax (II), IPI, ICMS and PIS/COFINS, CIDE, AFRMM and Taxes.
    • Customs Inspection: Strategic defense and monitoring of inspections by the Federal Revenue Service and other competent authorities, seeking to minimize the impacts and risks for clients in cases of inspection of goods or documents.
  3. Advice on Administrative and Judicial Litigation:
    • Defense in Customs Administrative Proceedings: Representation in administrative proceedings before the Brazilian Federal Revenue and other consenting bodies, in order to contest fines, penalties and demands.
    • Legal Actions for the Defense of Rights: Filing of legal actions, such as writs of mandamus, annulment and declaratory actions, to protect the rights of our clients in customs matters, including challenging illegal or excessive administrative acts.
    • Fines and Penalties Management: Advice on managing infractions and penalties imposed for non-compliance with customs regulations, with the aim of negotiating the reduction of sanctions and regularizing the company's situation with the competent bodies.
    • Administrative and Judicial Resources: Preparation and monitoring of administrative and judicial appeals against unfavorable decisions in the customs and tax spheres, with a focus on ensuring the best possible result for clients.
