PGFN allows early settlement of tax transactions with tax losses

On October 4, 2022, Ordinance No. 8,798 of the Attorney General's Office of the National Treasury (PGFN) was published, which instituted the Program for Early Settlement of Transactions and Registrations of the Active Debt of the Union of the Attorney General's Office of the National Treasury (QuitaPGFN).

This program provides special conditions for the settlement of tax transaction balances and the negotiation of registrations in the Union's unrecoverable or difficult-to-recover active debt, among which stands out the possibility of using tax losses and negative CSLL calculation basis for the payment of up to 70% of the remaining balance of the aforementioned amounts.

In return, the Ordinance requires payment of the remaining balance in cash or in up to 6 installments.[1]. The balances of tax debts subject to transactions signed up to October 31, 2022 and debts registered in the Union's Active Debt up to the date of publication of the Ordinance are eligible for the terms of QuitaPGFN.

Adhesion will take place through the Regularize Portal from 8 am on November 1, 2022 until 7 pm on December 30, 2022.


[1] For companies undergoing judicial recovery, the balance is increased to 12 installments.
