The City of São Paulo has put the drafts of the public notices for the concession of the 3rd and 4th lots of municipal parks in São Paulo out for public consultation. The management of units such as the Mario Covas Park and Tenente Siqueira Campos Park (Trianon) and its adjacent square, both on Avenida Paulista, and the Chuvisco Park, in the Ipiranga neighborhood, are to be put out to tender.

In general, public consultation is an instrument available to seek contributions from civil society and market agents on the policies and legal instruments that guide the public actions of each agency. Documents related to the public initiative are available for consultation for a set period, during which it is possible to submit suggestions, request clarifications or even criticize the project.

These are projects of significant relevance: the concession term for the Mario Covas and Trianon parks is 35 (thirty-five) years, with an estimated value of R$ 94,169,743.00 (ninety-four million, one hundred and sixty-nine thousand, seven hundred and forty-three reais). Suggestions, opinions or criticisms made in writing should be addressed to the Executive Secretariat for Privatization and Partnerships, from Monday to Friday, until July 6, 2020, accompanied by identification of the interested party. The public hearing is scheduled for July 3, via videoconference.

As for the Chuvisco park, the term is 25 (twenty-five) years with an estimated value of R$45,162,174.00 (forty-five million, one hundred and sixty-two thousand, one hundred and seventy-four reais), with the consultation open until July 15, 2020, and the public hearing scheduled for July 13.

According to the draft Notice and Contract, the proposed regime for the contracts is that of a common concession, in which the Concessionaire company will be remunerated through the collection of fees for the commercial exploitation of reserved areas within the parks, as well as other associated projects, with charging for entry and general use of public areas by users being prohibited.

The material related to the concession project for municipal parks is available on the São Paulo City Hall website.

The Public Law & Compliance team at Mazzucco & Mello Advogados will monitor the progress of the park concessions and will be available to provide any clarifications.
